Closure of Osiris Bar

Reference is being made to a letter entitled “Entertainment for teenagers stopped” by Mr Pierre Desira and Mr Leonard Desira, published on MaltaToday on the 2 April 2006 regarding ‘Osiris’ establishment in Marsaskala and Police action against this establishment. It was also alleged that the Police are failing to take action against other clubs.
Contrary to what was alleged in the letter, the Police effect inspections in all places of entertainment in Marsascala, as well as in all other localities, especially during the weekends. This can be confirmed by the charges issued against three other establishments in the same area during the same weekend. Incidentally writers can confirm this during the Divisional Court sitting.
When the Police Inspector ordered the closure of the ‘Osiris’, he was completely within the parameters of the law. Reference can be made to Sections 203 and 204 of Chapter 10 (Code of Police Laws) and Legal Notice 1 of 2006 Art. 38 (2a) to (2d), which stipulates that
“204. It shall be lawful for the Commissioner of Police for reasons of public order, public safety or public morality or by reason of the licensees’ lack of compliance with the provisions of regulations made under article 203 thereof, to order the suspension forthwith of any public performance, exhibition, show or entertainment, and likewise to order the suspension of any licence and the closing of any premises concerned for a period not in excess of fifteen days.”
