Enforcing court judgments
Not so long ago, an editorial in another English language newspaper unequivocally stated that members of the judiciary play a pivotal role in the country through their interpretation of the letter and the spirit of the law and central to their function is the mandatory enforcement of their judgments.
Since I am fully aware that Maltacom plc has been flouting a Superior Court definitive judgment for a number of years and no mandatory enforcement was ever applied by anyone, I wonder whether such a categorical opinion in this regard is entirely correct.
Who is actually responsible and accountable for such enforcement? Perhaps a Court of Justice official would explain to us lesser mortals?
