'Malicious' application for garnishee order rejected by court

The court also turned down a request by Floriana FC to fine its former president

A court has rejected a request filed by Floriana FC in which it asked to cancel a garnishee order “maliciously applied for“ by former club president Johann Said.

The football club had also requested that Said be fined an amount between €1,164.69 and €6,988.12, which it said would go towards the club, justifiying this odd request by saying that Said had acted maliciously when he filed a garnishee order against the club. The court also turned down this request.

The club contested the amounts alleged by Said, saying that they had no legal basis. Floriana said that this was the third precautionary warrant filed against them by Said with the intention of financially destabilising the club.

The court however said that it found no reason to impose a guarantee which could have led to the infringement of a creditor’s rights to secure his credit.

The elements required by law to revoke the garnishee were lacking, said the court and therefore the request for the imposition of the fine was also inadmissible.
