Waste managment company accuses Bormla council of ignoring court of appeal

The Court of Appeal had rescinded the contract and ordered an investigation into the matter, but the company is insisting that the only reaction to this judgment by the Bormla council was to change its lawyer.

A waste management company is seeking damages from the Bormla local council after it allegedly failed to obey a judgment of the Court of Appeal.

In the judicial protest, which was filed against Alison Zerafa Civelli and Joseph Caruana as Mayor and Executive Secretary of the Bormla local council respectively, WM Environmental Ltd made reference to a decision by the Court of Appeal dated 11 November, in which the court ordered the council to rescind the contract it had awarded to Saviour Mifsud and re-evaluate the tender, on the grounds of conflict of interest.

The Court of Appeal had rescinded the contract and ordered an investigation into the matter, but the company is insisting that the only reaction to this judgment by the Bormla council was to change its lawyer. Mifsud was still collecting rubbish, in spite of a call for applications being issued.

Lawyer John Bonello signed the protest.
