Man claims ARMS ignored court proceedings to cut off his power supply

A property owner is protesting the issuance of a final notice for payment of a bill that is the subject of arbitration proceedings

A Mellieha resident has filed a judicial protest against utilities supplier ARMS Ltd, after he received a final notice for payment of a bill that is currently the subject of arbitration proceedings.

In the protest, Jason Vella, who owns several properties in the apartment block, claims that in December 2014, he had negotiated and entered into an arrangement regarding three unpaid bills with the company, the total sum of which is allegedly in the region of €2,000.

However, in spite of this agreement - and on the very same day of its signing - ARMS filed arbitration proceedings against Vella. These proceedings are ongoing and will resume in late September.

In July, the power supply had been suspended in spite of the pending arbitration proceedings. This affected the use of the lift but was restored when the error had been brought to the company’s attention.

The protest claims that the final notice means that he now faces the prospect of being deprived of his electricity supply once again and is accusing  the company of causing him undue suffering through its gross negligence.

Lawyers Joseph Gatt and David Camilleri signed the protest.
