Notary investigated for fraud says he is in Italy, denies allegations

Notary accused of fraud denies allegations of not having registered contracts.

A notary who is reportedly abroad on the run from the law according to police sources, has made contact with MaltaToday from Italy denying the allegations.

Notary Pierre Falzon said it was a ‘blatant lie’ that he had not registered notarial contracts from June 2000, as told to this newspaper by the Public Registry.

But he also admitted not registering ‘some contracts’ due to health reasons.

A spokesperson for the parliamentary secretariat for lands said that Falzon was also being investigated on fraud allegations, for not registering property tax paid on notarial contracts with the Inland Revenue.

Falzon however claimed that all his contracts up to June 2000 had been handed over to the Notary to government. “I have not presented any more deeds to the Notary to government only because the mandate to Dr Joseph Sapiano to verify my contracts has not been extended,” Falzon said in an email.

“I refute any claim that I have in any way defrauded any person or company through my work as a notarial officer. I have not registered some contracts due to the fact that I have been abroad for some months due to health reasons of my family and myself.

“The police know my whereabouts and have both my telephone numbers in Italy. I have personally talked with Inspector Abdilla Cunningham [this week]. As soon as I am back in Malta (a matter of days) I will settle all pending matters regarding both my professional and my personal matters.”

Official sources had confirmed that the notary has not archived any contracts in the public registry since June 2000. Notary and Lija mayor Ian Castaldi Paris told MaltaToday that he is assisting a number of clients complaining about contracts that were not registered and did not have the stamp duty and government tax paid.

“As a notary and politician I want things to move along to ensure that these cases are not allowed to happen,” Castaldi Paris said. Castaldi Paris is presenting a number of proposals to make the profession accountable. “It is not acceptable to have notaries who do not archive contracts for over a year.”

I think it is great that people come out and stand up to be counted when they know that a person is above board, at least in what concerns them. In this context, I applaud Mr Pace who wrote in, in favour of Notary Pace. And I say this without in any way commenting about the problem.

on 2004 notary pierre falzon was the my notary when i bought my house i have his vat receipt and i have gov tax receipts as well ! so all was paid from the noarty side ! apart from that i was in contact with him early last year on other contracts , i was shocked when i could not contact him mostly because i know that he has always been a gentilmen to me and my family . personally i wish him well and it would be great to hear that he is back and settle all this . colin pace
