Maltese court rules in favour of Ryanair bag regulations

Court dismisses bag damage claims by Gasanmamo against low-fares giant.

Ryanair has welcomed a Maltese appeals court ruling that confirmed the low-fares airline's terms and conditions in relation to damaged bag claims comply with the Montreal Convention and dismissed bag damage claims made by the Gasan Mamo insurance company.

Gasanmamo had made claims against Ryanair for damaged bags, which did not meet the criteria set out in Ryanair's terms and conditions, which included the time limits specified under the Montreal Convention. These are agreed to by all Ryanair passengers at the time of booking.

"The insurance company claimed that Ryanair's terms and conditions were more onerous than the Montreal Convention and that the Convention limits should prevail. The Maltese court rejected this appeal and confirmed that Ryanair complied with the Montreal Convention and dismissed Gasan Mamo's claims.

"We welcome the ruling by the Maltese Courts which confirms that Ryanair's terms and conditions comply with the Montreal Convention and means that we will no longer suffer baseless bag damage claims from Gasanmamo," Ryanair's Stephen McNamara said.
