Man admits to damaging historical well

Mosta man pleads guilty to damaging historical well while carrying out excavation works in his property near St John’s Co-Cathedral in Valletta.

Duncan Fenech, 32 of Mosta  pleaded guilty to damaging property which forms part of Valletta’s cultural heritage.

The case dates back to 9 August, 2005. Fenech was carrying out refurbishment works in his property adjacent to St John’s Co-Cathedral in Valletta. The accused was in the process of converting his property into a retail outlet. However, while excavating in the basement, Fenech damaged the side wall of a historical well.

Inspector Michael Mallia charged Fenech with damaging property of cultural heritage. The accused admitted to the charges.

In today’s sitting, defence lawyer Joe Giglio informed the court that the damages had been repaired on the order of the Civil Court. “Since Fenech abided by court orders and immediately repaired the damages, the prosecution has agreed not to insist on the maximum punishment at law.

"Damage to historical property carries a maximum jail term of six years  but there is a provision that in minor incidents, the culprit is fined the value of the damages. in this case the amount was €2,500”, the lawyer said. The prosecution agreed.

Magistrate Giovanni Grixti put the case off until 15 October for judgement.
