Double decker bus driver acquitted of negligent driving

Bus driver acquitted of negligent driving after tourist who suffered fractures after an alleged sudden braking, failed to prove her case.

Bus driver George Tabone, 54, was acquitted of grievously injuring a tourist who fell the stairs of his double decker bus in 2012.

While on tour in Gozo, Maria Duncan Gerstlauer, 72, fell down the bus’s steps and suffered multiple fractures.

The victim alleged the incident was the driver’s fault after he applied sudden braking causing her to lose her balance.

With 28-years of experience, Tabone was charged with negligent driving leading to grievous injuries. He rebutted that the German woman and her husband had changed seats while the bus was in motion.

The woman fell when they attempted to access the vehicle’s upper level. Posters inside the bus warned passengers against moving while the bus was being driven.

The victim’s husband could not recall the timeline of events relating to where they were seated prior to the incident.

Magistrate Josette Demicoli acquitted the driver of all charges as no evidence was exhibited proving the incident happened through negligent driving.
