ST Microelectronics ordered to pay former employee €20,000

Former ST Microelectronics employee awarded €20,000 after Industrial Tribunal rules that ‘lack of faith’ in an employee is not a reason to terminate contract.

ST Microelectronics was ordered to pay a former employee, Sergio Ciantar, the sum of €20,000 after the court ruled that the reasons for job termination was unfounded.

Ciantar was and employee in the Purchasing Department of the company, and had his job terminated on May 9th 2009, through a letter signed by Human Resources Director, Tonio Portughese. The letter read that the company had lost faith in Ciantar due to his lack of discipline.

However the Industrial Tribunal, chaired by Franco Masini, ruled that ‘lack of faith’ is not a valid reason for termination.

Ciantar was awarded €20,000 in damages, but the tribunal ruled that the company was under no obligation to re-employ the plaintiff.
