Victim awarded €21,000 in damages after 2010 Paceville beating

The decision, by Judge Anthony Ellul, resulted from an action for damages filed by Adrian Agius against Steve Magro, Malcolm Buttigieg and Dylan Muscat.

A court has ordered three men to pay over €21,000 in damages to a third party, whom they had beaten up in Paceville five years ago, in a judgment handed down yesterday.

The decision, by Judge Anthony Ellul, resulted from an action for damages filed by Adrian Agius against Steve Magro, Malcolm Buttigieg and Dylan Muscat.

The court heard Agius testify how, in April 2010, he had been attacked in a bar in Paceville by the three men. The men had been arraigned before the Magistrates Court on charged with causing grievous bodily harm.  

The three had admitted to the criminal charges against them but were contesting Agius' civil action for damages.

The judge however noted that the court could not ignore the trio’s admission, adding that it was clear that they were responsible for the damages sustained.

A medical expert had reported testified Agius’ injuries to be serious and life-threatening, resulting in a five per cent permanent disability.

The court quantified the figure of €21,168 as compensation due.
